Making a claim in a Court

Litigation is an umbrella term meaning handling work which involves going to court.  It is wider than what is discussed on this page because it includes Family law actions, criminal actions which are discussed separately on this website.

If you have had any dispute with somebody or you are aggrieved because of some injustice which has happened to you, the chances are that you have some sort of claim against somebody. 

Most claims have as their main object the recovery of money.  The money claimed can be either a liquidated claim (which means that the amount claimed can be calculated) or unliquidated which means that the claim has to be evaluated by the court.  Most liquidated claims are money claims where a debt is owed under a contract.  Most compensation claims are unliquidated. 

There are many different ways of bringing somebody to court.  On this page, we discuss taking legal action against somebody in a case which is not an accident claim.  Here are some examples of the types of claim which we deal with

Before you go ahead with making a claim, we will discuss with you your likely prospects of success or what investigation is needed in order to evaluate it.  We will also discuss with you funding, including eligibility for legal aid.  The size of the claim also matters.  If your claim is smaller than £2000 (£5000 in England and Wales) the chances are that you will not be able to recover costs from your opponent.
