Our job when acting for a Seller (England and Wales)

These notes cover most of the processes but not necessarily everything.  At the outset, it should be noted that no job is exactly the same.

Before you have sold your property, you may visit us for advice or to notify us that you intend to sell.  At this point, we would discuss your Home Information Pack (HIP) with you.  It is now the law that you have to provide a Home Information Pack before you market a residential property.  The only exception is in relation to properties which are tenanted.

Broadly speaking, when acting for you as a seller, our job is divided up into the following parts.  Please click the links below for further information.

(c) Satisfying the buyer's requests for information and documentation
(d) Advising you on the contract
(e) Managing exchange of contracts
(f) Managing completion
(g) Post completion matters

The work which we carry out is within the following practising frameworks.  Firstly, we are obliged to comply with the Solicitor's Code of Conduct 2007.  The rules are now regulated by the Solicitors Regulation Authority. 

Secondly, the contracts that are issued and the documents used tend to be in standard formats.  If the sale is of a residential property, the contract used tends to be one which is subject to the Law Society's Standard Conditions of Sale 4th Edition.  It is very unusual for a transaction not to be subject to the Standard Conditions.
